In principle, you can use our website without providing any personal data. However, if you wish to make use of our services such as tutoring, learning support, homework help or social projects, we sometimes need to collect personal data from you, e.g. your name or email address. We always obtain your consent for this if there is no legal basis for it.
We comply with the General Data Protection Regulation (GDPR) and German data protection laws. With this statement, we would like to inform you about what data we collect, why we do this and what rights you have.
ELZ has taken many measures to protect your data. Nevertheless, data on the Internet can sometimes have security gaps. You can therefore also provide us with your data in other ways, e.g. by telephone or in person.
1. Definitions of terms
Our privacy policy uses terms from the General Data Protection Regulation (GDPR). To help you understand everything, we explain the most important terms:

- Data subject: This is you when we use your data.
- Processing: Everything we do with your data, e.g. store, use or delete it.
- Controller: This is ELZ Essener Lernzentrum gUG, because we decide how your data is used.

3. General information on the legal basis for processing
We only use your data if we have a legal basis for doing so. This may be:
- Your consent: you allow us to use your data (Art. 6 para. 1 lit. a GDPR).
- A contract: We need your data to fulfill a contract with you, e.g. to register for a tutoring course (Art. 6 para. 1 lit. b GDPR).
- Legal obligation: We must use your data, e.g. for tax authorities (Art. 6 para. 1 lit. c GDPR).
- Legitimate interest: We use your data to improve our work, e.g. to make our courses better, as long as your rights are not violated (Art. 6 para. 1 lit. f GDPR).
4. Rights of the data subject
You have many rights when it comes to your data. Here are the most important ones:
- Right of access: you can ask what data we have about you (Art. 15 GDPR).
- Right to rectification: If your data is incorrect, we can correct it (Art. 16 GDPR).
- Right to erasure: You can request that we erase your data if we no longer need it (Art. 17 GDPR).
- Right to restriction: You can say that we may only use your data to a limited extent (Art. 18 GDPR).
- Right to data portability: You can receive your data in a simple format so that it can be used elsewhere (Art. 20 GDPR).

5. Data security
Our website uses a secure connection (TLS encryption) to protect your data. You can recognize this by the "https://" in the address bar and the lock symbol in your browser. This means that your data cannot be read by others. We also have organizational measures, e.g. access controls for our employees, to protect your data. Nevertheless, we cannot guarantee absolute protection on the Internet.
6. Collection of general data when you visit the website
When you visit our website, we automatically store some general data, e.g:
- Which browser you are using
- Which page you visited previously
- The date and time of your visit
- Your IP address
This data helps us to improve our website and protect it from attacks. It does not allow us to see who you are. The data is stored separately from your personal data and deleted after 7 days, unless it is needed longer for security purposes.
Legal basis: Legitimate interest (Art. 6 para. 1 lit. f GDPR) to make our website secure and user-friendly.
7. Information on data processing in the context of our offers
7.1 Contact option via the website
You can write to us by email or via a contact form. If you do so, we will store the data you provide to us, e.g. your name or e-mail address. We only use this data to answer your query. We do not pass it on to others unless required by law.
Legal basis: Your consent (Art. 6 para. 1 lit. a GDPR) or legitimate interest (Art. 6 para. 1 lit. f GDPR) to process your request.
7.2 Registration for tutoring, learning support and homework help
When you register for tutoring, learning support or homework help, we store the data you give us, e.g. your name, your telephone number, your e-mail address and details about your child (e.g. name, age, class). We use this data to organize the course, to inform you and to conduct the lessons. Sometimes we pass the data on to cooperation partners, e.g. SC Frintrop 05/21 e.V., if the course takes place there. We only do this if it is necessary for the course.
Legal basis: Performance of contract (Art. 6 para. 1 lit. b GDPR), as we need the data to fulfill the course contract with you.
7.3 Registration for social projects
For our social projects, e.g. "Ukrainian lessons", "HipHop for girls" or "Food4futures", we collect similar data as for tutoring: name, contact details and information about the participants (e.g. age, interests). We use this data to organize and carry out the project. For some projects, we work together with partners, e.g. Theodor Goldschmidt Realschule, and only pass on the data if it is necessary for the project.
Legal basis: Performance of a contract (Art. 6 para. 1 lit. b GDPR) or your consent (Art. 6 para. 1 lit. a GDPR) if the project has no contractual basis.
7.4 Satisfaction survey
After a course or project, we may send you an email asking whether you were satisfied. This helps us to improve our services. You do not have to answer if you do not want to. We store your answers anonymously so that no one can see who gave them.
Legal basis: Legitimate interest (Art. 6 para. 1 lit. f GDPR) to improve our offers.
7.5 Special regulations for children
As many of our offers concern children and young people, we pay particular attention to the protection of their data. For children under the age of 16, we obtain parental consent before using their data (Art. 8 GDPR). We ensure that information is understandable for children and do not pass on children's data to third parties unless it is necessary for the course or project (e.g. to cooperation partners).
Legal basis: Consent of the parents (Art. 6 para. 1 lit. a GDPR) and fulfillment of the contract (Art. 6 para. 1 lit. b GDPR).
8. Routine erasure and blocking of personal data
We only store your data for as long as we need it, e.g. to organize a course or project or to comply with legal regulations. When we no longer need the data, we delete it. We have to keep some data for longer, e.g. for tax authorities (up to 10 years). In this case, we block the data so that it can no longer be used until it is deleted.
9. Data protection for job applications
If you apply for a job with us, e.g. as a course instructor, we store your application data (e.g. CV, cover letter) in order to process the application process. We do not pass the data on to others and delete it 6 months after completion of the application process, unless we need to keep it for longer (e.g. for legal deadlines).
Legal basis: Fulfillment of contract (Art. 6 para. 1 lit. b GDPR) and legitimate interest (Art. 6 para. 1 lit. f GDPR).
10. Legal or contractual provisions for the provision of data
Sometimes you have to provide us with data, e.g. when you register for a course. Without this data, we cannot organize the course. If you do not provide us with the data, you will not be able to participate. We will always tell you what data we need and why.
11. Existence of automated decision making
We do not use automated decision-making or profiling to make decisions about you (Art. 22 GDPR).
12. Processing of data in Germany
We process your data mainly in Germany. If we work together with cooperation partners, e.g. SC Frintrop 05/21 e.V., we only pass on your data if this is permitted. If data is transferred to partners outside the EU (e.g. when using online tools), we ensure that your data is protected, e.g. through standard contractual clauses (Art. 46 GDPR).
13. Links to our social media presences
We have links to our pages on Facebook, Instagram and other platforms. If you use these links, the data protection rules of these platforms apply. Please read the privacy policies there.
14. Changes to our privacy policy
We may change this privacy policy, e.g. if laws change or we have new offers. The new statement will then apply when you visit our site again. We will publish changes on our website.
